A BILL TO BE ENTITLED
AN ACT
relating to the authority of the Texas Department of Transportation
to enter into funding agreements to expedite an agency's
environmental review duties related to transportation projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter H, Chapter 201, Transportation Code,
is amended by adding Section 201.6045 to read as follows:
Sec. 201.6045. AUTHORIZATION TO PROVIDE ASSISTANCE TO
EXPEDITE ENVIRONMENTAL REVIEW. The department may enter into an
agreement to provide funds to a state or federal agency to expedite
the agency's performance of its duties related to the environmental
review process for a transportation project of the department.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
