A BILL TO BE ENTITLED
AN ACT
relating to an exception to the purchase of a refrigerant or
equipment containing a refrigerant.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 1302.453(b), Occupations Code, is
amended to read as follows:
(b) It is an exception to the application of this section
with respect to a purchase of a refrigerant or equipment containing
a refrigerant in this state in violation of Section 1302.356(1)
[1302.356] that:
(1) the refrigerant or equipment is purchased for use
in a commercial or residential air conditioning system that
requires 15 pounds or less of refrigerant; or
(2) the refrigerant or equipment is purchased for use
only in a motor vehicle and that use is authorized by the United
States Environmental Protection Agency.
SECTION 2. The change in law made by this Act applies only
to an offense committed on or after the effective date of this Act.
An offense committed before the effective date of this Act is
covered by the law in effect when the offense was committed, and the
former law is continued in effect for that purpose. For purposes of
this section, an offense was committed before the effective date of
this Act if any element of the offense occurred before that date.
SECTION 3. This Act takes effect September 1, 2009.
