The bill would amend the Civil Practice and Remedies Code to add to the list of activities that comprise a public nuisance. The proposed change in statute would apply only to a cause of action that accrues on or after the effective date of the bill, which would be September 1, 2009.Enforcement actions against a public nuisance may be taken at the state or the local government level. It is anticipated that costs of any additional enforcement actions could be absorbed within existing resources.
