O'Brien, Director, Legislative Budget Board     IN RE:SB74 by Nelson (Relating to limitation of liability for certain emergency care provided during a declared disaster.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Civil Practices and Remedies Code relating to limitation of a liability for certain emergency care provided during a declared disaster. The bill would exempt physicians or health care providers from liability for providing emergency care during the scope of their employment at the scene of a disaster. To the extent the bill amends limitations of liability, the rules change is not anticipated to increase the workload of the courts. The bill would take effect immediately if it receives a two-thirds vote of each house. If the bill does not receive the necessary votes the bill would take effect September 1, 2009. Local Government Impact No significant fiscal implication to units of local government is anticipated.
