O'Brien, Director, Legislative Budget Board IN RE:SB747 by Carona (Relating to notice of a hospital lien.), As Engrossed No fiscal implication to the State is anticipated. The bill would amend the Property Code to require a hospital or emergency medical services provider seeking to secure a lien on a cause of action or claim of an individual who receives hospital services for injuries caused by an accident that is attributed to the negligence of another person, to send a written notice of the lien, certified and return receipt requested, to the injured individual at the person's last known address. The notice must be sent not later than the 10th day before the date a hospital or emergency services provider files a notice with the county clerk. The bill specifies what information is required to be included in the written notice. No notice would have to be mailed under certain circumstances identified in the bill. Local Government Impact No significant fiscal implication to units of local government is anticipated.
