A BILL TO BE ENTITLED AN ACT relating to the election, and validation of acts, of members of the board of directors of Anderson County Underground Water Conservation District. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 9, Chapter 992, Acts of the 70th Legislature, Regular Session, 1987, is amended to read as follows: Sec. 9. ELECTION OF DIRECTORS. An [Beginning in the second year following the creation election, an] election shall be held on the uniform election date [third Saturday] in May every two years to elect the appropriate number of directors to the board. SECTION 2. (a) All governmental and proprietary actions of the Anderson County Underground Water Conservation District taken before the effective date of this Act are validated, ratified, and confirmed in all respects as if the actions had been taken as authorized by law. (b) This section does not apply to any matter that on the effective date of this Act: (1) is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment; or (2) has been held invalid by a final court judgment. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2009. * * * * *
