 A BILL TO BE ENTITLED
 AN ACT
 relating to the capability of the Public Education Information
 Management System (PEIMS) to provide information regarding public
 school students placed in foster care.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 42.006, Education Code, is amended by
 adding Subsection (c-1) to read as follows:
 (c-1)  The commissioner's rules must ensure that the Public
 Education Information Management System contains all information
 necessary to permit the agency to track the performance of students
 placed in foster care. As necessary to achieve that capability, the
 Department of Family and Protective Services shall provide school
 districts or the agency, as appropriate, with information regarding
 the identity of students placed in foster care. Information
 provided by the Department of Family and Protective Services under
 this subsection or contained in the Public Education Information
 Management System regarding the specific identity of students in
 foster care is confidential, and the privacy of those students must
 be protected in accordance with rules adopted by the commissioner.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
