LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION April 22, 2009 TO: Honorable Robert Duncan, Chair, Senate Committee on State Affairs FROM: John S. O'Brien, Director, Legislative Budget Board IN RE:SJR29 by Ogden (Proposing a constitutional amendment requiring a candidate for public office to win by a margin of one percent of the votes cast at the election before the candidate is elected to that office.), As Introduced No significant fiscal implication to the State is anticipated, other than the cost of publication. The cost to the state for publication of the resolution is $90,882. The joint resolution would require that a proposed amendment to the state constitution be submitted to the voters in an election to be held November 3, 2009. The proposed amendment would change the method for determining the winner in an election for public office, except for a federal office. Local Government Impact There is no direct fiscal implications to units of local government by the addition of the proposed constitutional amendment to the election ballot. Upon passage, the possibility of an increase in the number of elections for which a runoff election must be held would create additional election costs for the affected entity.
