LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION April 7, 2011 TO: Honorable Mike Hamilton, Chair, House Committee on Licensing & Administrative Procedures FROM: John S O'Brien, Director, Legislative Budget Board IN RE:HB1092 by Christian (Relating to the exemption from certain construction requirements for volunteer fire departments in certain counties.), As Introduced No fiscal implication to the State is anticipated. The bill would amend the Occupations Code to exempt a building or other facility that is occupied exclusively by a volunteer fire department in a county with a population of 80,000 or less, that is not routinely used by the public, is approved by an engineer, and has a slab that is approved by an engineer from requirements related to the construction of certain public works. The bill would in effect allow construction of certain public works in smaller counties by the state or a political subdivision without obtaining engineering plans, specifications, and estimates prepared by an engineer and without having the engineering construction performed under the direct supervision of an engineer if engineering approval has already occurred for a building or other facility, and the slab for the building or facility. This exemption would provide a savings in the costs of a construction project. It is not anticipated that the state would construct a public work affecting a building occupied by a volunteer fire department; therefore, the fiscal implications are expected to affect local government entities only. Local Government Impact No significant fiscal implication to units of local government is anticipated.
