A BILL TO BE ENTITLED
AN ACT
relating to the use of safety guards or flaps on certain buses.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 547.606, Transportation Code, is amended
by amending Subsection (a) and adding Subsection (a-1) to read as
follows:
(a) This section applies only to:
(1) a school bus, a school activity bus, or a
multifunctional school activity bus operating outside the
boundaries of a municipality; or
(2) a [A] road tractor, truck, trailer, truck-tractor
in combination with a semitrailer, or semitrailer in combination
with a towing vehicle that has at least four tires on the rearmost
axle of the vehicle or the rearmost vehicle in the combination.
(a-1) A vehicle described by Subsection (a) shall be
equipped with safety guards or flaps that:
(1) are of a type prescribed by the department; and
(2) are located and suspended behind the rearmost
wheels of the vehicle or the rearmost vehicle in the combination
within eight inches of the surface of the highway.
SECTION 2. This Act takes effect September 1, 2011.
