                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            April 29, 2011      TO: Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB118 by McClendon (Relating to requiring the provision of notice by certain hospitals regarding patients' medical records.), As Engrossed    No significant fiscal implication to the State is anticipated.  The bill amends Section 241.103 of the Health and Safety Code to require a hospital to provide written notice to a patient or a patients legally authorized representative, as defined in Section 241.151, that the hospital may dispose of medical records relating to the patient within the periods specified in Section 241.103. In an emergency treatment situation, the notice must be provided as soon as reasonably practicable. It is assumed any costs associated with this provision could be absorbed within existing agency resources.
