Fiscal Analysis

The bill would amend the Occupations Code to require the Commission on Law Enforcement Officers Standards and Education (TCLEOSE) to designate an electromagnetic pulse device to disable a motor vehicle if the Commission determines the device is suitable for use by officers. TCLEOSE would also be required to establish a voluntary training program of licensed officers that provides instruction in the use of these devices, and administer the training program and issue a certificate of proficiency to each officer that the Commission determines has successfully completed the training program. This bill would take effect September 1, 2011.

Methodology

TCLEOSE would be required to evaluate electromagnetic pulse devices to determine their appropriateness for use in law enforcement, and prepare a recommendation for law enforcement agencies. TCLEOSE estimates that this would require 40 hours of research at $2,000. The bill would require the creation of a curriculum and lesson plan for a four-hour continuing-education course. TCLEOSE's standard curriculum design takes an estimated minimum of 8 hours of development per course hour. The agency estimates the cost of this section at $2,000. The bill would require the creation and use of a new type of proficiency certificate; however, the Commission would be able to recover this particular expense through a $25-50 processing fee.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
