Fiscal Analysis

The bill would create the Texas State Civilian Complaint Review Board to investigate allegations of peace officer misconduct.  The nine member board would be appointed by the governor from a list of candidates submitted by the lieutenant governor, speaker of the house of representatives, and the attorney general.  The board members would be appointed for two-year teams and the governor would designate a board member as the presiding officer to serve at the pleasure of the governor.  Ineligibility, grounds for removal, general powers and duties, complaint investigation process, subpoenas, dismissal of complaints and complaint determination responsibilities by the board are included in the bill.   Members of the board are entitled to a per diem of $150 for each day the member engages in board business, and board members are entitled to reimbursement for actual and necessary expenses incurred in performing the official duties of the board.  The total per diem a board member may receive during a fiscal year may not exceed $5,000.  The Board shall employ an executive director to administer the policies of the board.  The board may employ personnel as necessary to exercise its powers and appoint investigators who have previous investigative experience to investigate complaints filed under this chapter.   The bill would take effect on September 1, 2011 and the initial members of the Texas State Civilian Complaint review Board shall be appointed not later than October, 1, 2011.  

Methodology

This analysis assumes that the nine member board would each require $5,000 per year in reimbursement for actual and necessary expenses incurred in performing official duties.  It is also assumed that a total of eight FTEs with associated costs, including 1 Executive Director, 2 Administrative Assistants, and 5 Investigators would be necessary, with associated costs, to carry out the provisions of the bill.  This analysis assumes one-time costs for workstation furniture of $36,800, $8,000 for personal computers, and $2,920 for telephone set up; all in fiscal year 2012.  Associated yearly costs include salary ($430,306) and benefits (28.57%), telephone yearly service ($1,704), consumable supplies ($2,400), rent, and travel expenses.
