A BILL TO BE ENTITLED
AN ACT
relating to the authority of the Texas Department of Motor Vehicles
to contract with certain entities to provide a department service.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 1001, Transportation Code,
is amended by adding Section 1001.007 to read as follows:
Sec. 1001.007. AUTHORITY TO CONTRACT. (a) The department
may contract with a private entity to wholly or partly provide a
service otherwise provided by the department if the department
determines that the private entity can provide the service more
efficiently than the department.
(b) In making a determination under Subsection (a), the
department shall consider the cost to the state of contracting for
the provision of the service from the private entity.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
