 A BILL TO BE ENTITLED
 AN ACT
 relating to elections to confirm the creation of certain water
 districts.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter B, Chapter 53, Water Code, is amended
 by adding Section 53.0201 to read as follows:
 Sec. 53.0201.  REGISTERED VOTERS REQUIRED FOR CONFIRMATION
 ELECTION. (a) If, under Section 53.020, the commissioners court
 grants a petition to create a district, the district may be created
 only if at least 40 registered voters reside in the district on the
 date of the election held to confirm the district's creation.
 (b)  This section prevails over a conflicting or
 inconsistent provision of a special or local law that governs a
 specific district.
 SECTION 2.  Subchapter B, Chapter 54, Water Code, is amended
 by adding Section 54.0211 to read as follows:
 Sec. 54.0211. REGISTERED VOTERS REQUIRED FOR CONFIRMATION
 ELECTION. (a) If, under Section 54.021, the commission grants a
 petition to create a district, the district may be created only if
 at least 40 registered voters reside in the district on the date of
 the election held to confirm the district's creation.
 (b)  This section prevails over a conflicting or
 inconsistent provision of a special or local law that governs a
 specific district.
 SECTION 3.  Sections 53.0201 and 54.0211, Water Code, as
 added by this Act, apply only to a district for which a petition is
 granted on or after the effective date of this Act. A district for
 which a petition is granted before the effective date of this Act is
 subject to the law in effect when the petition is granted, and that
 law is continued in effect for that purpose.
 SECTION 4.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
