The bill would add Section 42.0255 to the Local Government Code to define adopting municipality and releasing municipality. The governing body of an adopting municipality, by resolution, would be authorized to petition a releasing municipality to release an area in the extraterritorial jurisdiction (ETJ) of the releasing municipality located contiguous to and within a one-half mile of the boundaries surrounding the adopting municipality. The governing body of a releasing municipality would be required to release the area not later than the 30th day after receiving a petition, unless the area has been annexed for limited purposes; has been included in the releasing municipalitys annexation plan for at least one year; or is proposed for annexation and is not required to be included in the annexation plan. The governing body of an adopting municipality would be required to confirm the inclusion of the released area in the municipalitys ETJ by ordinance or resolution.
