The bill proposes to amend Section 243 of the Texas Probate Code regarding an allowance from a decedents estate for devisees in and beneficiaries of a will who defend and prosecute certain proceedings relating to the will. The proposed amendments require that the person be successful in the proceedings related to the will in order to qualify for the allowance. Prior law provided that the person could qualify for the allowance whether successful or not in the proceeding related to the will. Local Government Impact No significant fiscal implication to units of local government is anticipated.
