                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            March 27, 2011      TO: Honorable Pete Gallego, Chair, House Committee on Criminal Jurisprudence      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB1973 by Lucio III (Relating to the admissibility of certain statements in the prosecution of murder or capital murder.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Code of Criminal Procedure relating to the admissibility of certain statements in the prosecution of murder or capital murder.  The proposed amendment would make statements obtained under certain conditions not be subject to challenge based upon the hearsay rule. To the extent the bill would amend court procedures, no significant fiscal implication to the State is anticipated. The bill would take immediate effect if the bill receives two-thirds the vote of all members in both houses.  Otherwise, the bill would take effect September 1, 2011. Local Government Impact No significant fiscal implication to units of local government is anticipated.
