                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            March 12, 2011      TO: Honorable Byron Cook, Chair, House Committee on State Affairs      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB1997 by Shelton (Relating to customer choice for certain state agencies served by a municipally owned electric utility.), As Introduced    There would be an indeterminate savings to the state from the provisions of the bill because it would allow a state agency whose facility is located in Travis County the right to participate in customer choice.   The bill would amend the Utilities Code to allow a state agency whose facility is located in Travis County the right to participate in customer choice. It is assumed that a state agency would not elect to participate in customer choice unless savings could be achieved. However, since the savings would depend on the actions of electricity providers in negotiating rates with state agencies and the price of electricity, savings to the state cannot be determined. Local Government Impact It is anticipated that there would be an indeterminate cost to local government entities that own an electric utility that provides service to a state agency if that state agency elected to participate in customer choice. However, since cost would depend on the actions of state agencies in negotiating rates with electricity providers, costs to local entities cannot be determined.
