A BILL TO BE ENTITLED
AN ACT
relating to annual renewal of a Texas windstorm insurance policy.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 2210.203(c), Insurance Code, is amended
to read as follows:
(c) A policy is automatically [may be] renewed annually [on
application for renewal] as long as the property continues to be
insurable property, or until canceled as provided by Section
2210.204. The association may require evidence that the property is
covered by a flood insurance policy in accordance with Subsection
(a-1) before the renewal is effective.
SECTION 2. Section 2210.203(c), Insurance Code, as amended
by this Act, applies only to an insurance policy that is delivered,
issued for delivery, or renewed on or after January 1, 2012. A
policy delivered, issued for delivery, or renewed before January 1,
2012, is governed by the law as it existed immediately before the
effective date of this Act, and that law is continued in effect for
that purpose.
SECTION 3. This Act takes effect September 1, 2011.
