                    BILL ANALYSIS             H.B. 2247     By: King, Phil     Defense & Veterans' Affairs     Committee Report (Unamended)             BACKGROUND AND PURPOSE    The Texas ChalleNGe Academy could use funds from the Foundation School Program to provide the state match for federal dollars, allowing the academy to continue to provide free physical training, life skills, and academic instruction to high school students at risk of dropping out or who have already dropped out of school.    H.B. 2247 seeks to help the Texas ChalleNGe Academy continue its important mission by establishing the eligibility of the adjutant general's department to receive Foundation School Program funding for students enrolled in the Texas ChalleNGe Academy.        RULEMAKING AUTHORITY    It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.       ANALYSIS    H.B. 2247 amends the Government Code to entitle the adjutant general's department, for each student enrolled in the Texas ChalleNGe Academy, to allotments from the Foundation School Program as if the academy were a school district without a tier one local share for purposes of provisions relating to the distribution of the foundation school fund. The bill requires the department to contract with an appropriate school district for the provision of educational services for students enrolled in the academy. The bill requires the school district with which the department contracts to be responsible for ensuring compliance with any applicable regulatory requirements imposed under the Education Code and enforced by the commissioner of education and the Texas Education Agency.       EFFECTIVE DATE    On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
