The bill would amend Section 1, Chapter 1036 (House Bill 1759), Acts of the 80th Legislature, Regular Session, 2007, by the addition of Subsections (f-2), (f-3), (f-4), and (f-5). House Bill 1759 provided for the transfer of state owned property located in Beaumont, Jefferson County, Texas to Spindletop MHMR Services.    The bill would allow property transferred from the State to Spindletop MHMR Services to be conveyed through sale or lease to another entity. In addition to provision of community-based mental health or mental retardation services, the property could be used for provision of community-based physical health, health related, mental health or mental retardation services. In addition, any conveyance must provide that ownership of the property automatically reverts to the state on the date that the entity or organization fails to use the property in a manner that promotes a public purpose of the state by providing community-based physical health, health related, mental health or mental retardation services.  The Act would take effect September 1, 2011. Local Government Impact No fiscal implication to units of local government is anticipated.
