                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            March 25, 2011      TO: Honorable Jim Jackson, Chair, House Committee on Judiciary & Civil Jurisprudence      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB2437 by Sheets (Relating to an award of litigation costs after the rejection of certain settlement offers.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Civil Practice and Remedies Code to require a court, upon request, to conduct a hearing for an award of litigation costs. The bill also would require litigation costs awarded to a defendant not to exceed the amount of a defendant's most recent settlement offer. According to the Office of Court Administration (OCA), although the court would be required to hold a hearing upon request, the provisions would not appreciably increase the court's time; therefore, no significant fiscal impact is anticipated. Local Government Impact No significant fiscal implication to units of local government is anticipated.
