The bill would amend the Civil Practice and Remedies Code to require a court, upon request, to conduct a hearing for an award of litigation costs. The bill also would require litigation costs awarded to a defendant not to exceed the amount of a defendant's most recent settlement offer. According to the Office of Court Administration (OCA), although the court would be required to hold a hearing upon request, the provisions would not appreciably increase the court's time; therefore, no significant fiscal impact is anticipated. Local Government Impact No significant fiscal implication to units of local government is anticipated.
