A BILL TO BE ENTITLED
AN ACT
relating to municipal prohibition of the use of low-speed vehicles
to transport passengers for hire.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 215, Local Government
Code, is amended by adding Section 215.005 to read as follows:
Sec. 215.005. PROHIBITION ON LOW-SPEED VEHICLES FOR HIRE.
(a) In this section, "low-speed vehicle" means a four-wheeled,
battery-powered vehicle with a maximum speed of less than 35 miles
per hour and a gross weight of less than 3,000 pounds.
(b) A municipality shall prohibit in the municipality the
use of low-speed vehicles to transport passengers for compensation.
SECTION 2. This Act takes effect September 1, 2011.
