LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION April 14, 2011 TO: Honorable Garnet Coleman, Chair, House Committee on County Affairs FROM: John S O'Brien, Director, Legislative Budget Board IN RE:HB2617 by Harless (Relating to the regulation of the sale and use of fireworks by certain counties; providing penalties.), As Introduced No significant fiscal implication to the State is anticipated. The bill would add a new section to Chapter 352 of the Local Government Code to allow the commissioners court of a county with a population of 3.3 million or more to prohibit or regulate the sale or use of fireworks in the unincorporated area of the county. Based on the population limitation specified in the bill, the new section would apply only to Harris County. It is not known whether the Harris County commissioners court would decide to regulate or prohibit the sale of fireworks. However, if the Harris County commissioners court were to prohibit the sale of fireworks in the unincorporated area of the county, there would be a marginal reduction in state and local tax revenue. The bill would take effect immediately upon enactment, assuming that it received the requisite two-thirds majority votes in both houses of the Legislature. Otherwise, it would take effect September 1, 2011. Local Government Impact No significant fiscal implication to units of local government is anticipated.
