The bill would amend the Utilities Code relating to cable attachments to electric facilities of electric co-operatives. The bill requires an electric cooperative to provide written approval or denial of a cable attachment request and prohibits electric cooperatives from denying a cable company access to its facilities for certain reasons. The bill requires an electric cooperative to negotiate in good faith the rates, terms, and conditions for access to and use of electric facilities when a cable attachment request is received. The bill states that an aggrieved electric cooperative or cable company may file a complaint with the Public Utility Commission. Based on the analysis of the Public Utility Commission, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
