The bill would amend the Transportation Code to include gross weight as a measure to be considered for the affirmative defense of operating a vehicle over the maximum allowable weight. Under current statute, the affirmative defense for operating a vehicle is over maximum allowable axel weight. Local Government Impact No significant fiscal implication to units of local government is anticipated.
