The bill would amend the Transportation Code to include gross weight, and a single axle or tandem axle weight heavier than the axle weight that was issued a permit under Section 623.011, as a measure to be considered for the affirmative defense of operating a vehicle over the maximum allowable weight. Under current statute, the affirmative defense for operating a vehicle is over maximum allowable axel weight.
