                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            April 28, 2011      TO: Honorable Larry Phillips, Chair, House Committee on Transportation      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB2730 by White (Relating to weight limits on a vehicle loaded with certain agricultural products.), Committee Report 1st House, Substituted    No fiscal implication to the State is anticipated.  The bill would amend the Transportation Code to include gross weight, and a single axle or tandem axle weight heavier than the axle weight that was issued a permit under Section 623.011, as a measure to be considered for the affirmative defense of operating a vehicle over the maximum allowable weight. Under current statute, the affirmative defense for operating a vehicle is over maximum allowable axel weight.
