A BILL TO BE ENTITLED
AN ACT
relating to the application requirements for a local project
permit.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 245.001, Local Government Code, is
amended by amending Subdivision (1) and adding Subdivision (1-a) to
read as follows:
(1) "Fair notice" means the minimum amount of
information necessary to enable a reasonably prudent person to
understand the general nature and objective of a project.
(1-a) "Permit" means a license, certificate, approval,
registration, consent, permit, contract or other agreement for
construction related to, or provision of, service from a water or
wastewater utility owned, operated, or controlled by a regulatory
agency, or other form of authorization required by law, rule,
regulation, order, or ordinance that a person must obtain to
perform an action or initiate, continue, or complete a project for
which the permit is sought.
SECTION 2. The changes in law made by this Act to Section
245.001, Local Government Code, apply only to an application for a
permit submitted for approval on or after the effective date of this
Act. An application for a permit submitted for approval before the
effective date of this Act is governed by the law in effect when the
application was submitted, and the former law is continued in
effect for that purpose.
SECTION 3. This Act takes effect September 1, 2011.
