                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            March 29, 2011      TO: Honorable Byron Cook, Chair, House Committee on State Affairs      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB2841 by Gallego (Relating to the authority of the Public Utility Commission of Texas to protect telecommunications network integrity from unauthorized or uncompensated use.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Utilities Code related to the authority of the Public Utility Commission (PUC) to protect telecommunications network integrity from unauthorized or uncompensated use. The bill would require the PUC to establish rules requiring carriers to properly identify traffic being terminated to the public switched telephone network and respond to complaints regarding unauthorized or fraudulent traffic. The bill would require the PUC to adopt procedures to mandate and enforce inter-carrier compensation agreements. The bill would allow the PUC to impose reasonable administrative penalties for a violation of rule or order. Based on the analysis of the PUC, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
