 A BILL TO BE ENTITLED
 AN ACT
 relating to deferral of certain surcharge payments for active duty
 military personnel.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 708.103, Transportation Code, is amended
 by adding Subsection (c) to read as follows:
 (c)  The department by rule shall establish a deferral
 program for surcharges assessed against a person who is on active
 duty in the United States armed forces. The program must:
 (1)  toll the 36-month period while the person is on
 active duty; and
 (2)  defer assessment of surcharges under this section
 against the person on active duty until the date the person is no
 longer on active duty for an offense committed:
 (A)  before the person was on active duty; or
 (B)  while the person is on active duty.
 SECTION 2.  This Act takes effect September 1, 2011.
