The bill would amend the Civil Practice and Remedies Code to add to the list of activities that comprise a public nuisance. Enforcement actions against a public nuisance may be taken at the state or the local government level. It is anticipated that costs of any additional enforcement actions could be absorbed within existing resources. The proposed change in statute would apply only to a cause of action that accrues on or after the effective date of the bill, which would be September 1, 2011.
