                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            May 9, 2011      TO: Honorable Troy Fraser, Chair, Senate Committee on Natural Resources      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB3002 by Hughes (Relating to certain conservation and reclamation districts exempted from filing a full audit.), As Engrossed    No significant fiscal implication to the State is anticipated.  The bill would allow conservation and reclamation districts whose gross receipts would not be in excess of $250,000 in a fiscal year, as opposed to $100,000 under current law, file annual financial reports with the Texas Commission on Environmental Quality (TCEQ), instead of having an audit performed and submitting an audit report. The TCEQ reports that the bill's passage is not expected to result in a significant fiscal impact to the agency. Local Government Impact A district could save the cost of an independent audit and audit report as a result of the bills provisions if it meets all the criteria listed in section 49.198 (a) of the Water Code including gross receipts of $250,000 or less instead of gross receipts of $100,000 or less.
