       AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   Current law authorizes the commissioners court of a county with a population of 2.8 million or more to issue an identification card to individuals permitting entrance into a county building that houses a justice court, county court, county court at law, or district court without passing through security. The commissioners court may set a reasonable fee for the issuance of the identification card to individuals other than county employees. H.B. 3003 expands this authority to all counties by removing the population threshold.    H.B. 3003 amends current law relating to the issuance of an identification card to certain individuals to permit entrance into certain county buildings without passing through security services.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.    SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 291.010(a), Local Government Code, as follows:   (a)  Authorizes the commissioners court of a county, rather than a county with a population of 2.8 million or more, by order, to:   (1)  authorize the issuance of an identification card to individuals permitting entrance into a county building that houses a justice court, county court, county court at law, or district court without passing through the security services provided under Article 102.017 (Court Costs; Courthouse Security Fund; Municipal Building Security Fund; Justice Court Building Security Fund), Code of Criminal Procedure; and   (2)  set a reasonable fee for the issuance of the identification card to individuals other than county employees.   SECTION 2. Effective date: September 1, 2011.

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 291.010(a), Local Government Code, as follows:

 

(a)  Authorizes the commissioners court of a county, rather than a county with a population of 2.8 million or more, by order, to:

 

(1)  authorize the issuance of an identification card to individuals permitting entrance into a county building that houses a justice court, county court, county court at law, or district court without passing through the security services provided under Article 102.017 (Court Costs; Courthouse Security Fund; Municipal Building Security Fund; Justice Court Building Security Fund), Code of Criminal Procedure; and

 

(2)  set a reasonable fee for the issuance of the identification card to individuals other than county employees.

 

SECTION 2. Effective date: September 1, 2011.
