A BILL TO BE ENTITLED
AN ACT
relating to processing applications for certain alcoholic beverage
licenses or permits.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 11, Alcoholic Beverage
Code, is amended by adding Section 11.311 to read as follows:
Sec. 11.311. TIME FOR PROCESSING APPLICATIONS. (a) Not
later than the 30th day after the date the commission receives an
application for a permit, the commission shall notify the applicant
if the application is incomplete.
(b) Not later than the 90th day after the date the
commission receives a completed application for a permit, the
commission shall approve or deny the application and notify the
applicant of the commission's decision.
SECTION 2. Subchapter B, Chapter 61, Alcoholic Beverage
Code, is amended by adding Section 61.331 to read as follows:
Sec. 61.331. TIME FOR ACTION BY COMMISSION OR
ADMINISTRATOR. The commission's or administrator's decision to
issue or refuse to issue a license under Section 61.33 must be made
not later than the 90th day after the date the commission receives a
report under Section 61.32(b) certifying that the license
application was approved by the county judge.
SECTION 3. This Act takes effect September 1, 2011.
