A BILL TO BE ENTITLED
AN ACT
relating to a prohibition on school districts employing under a
contract a person whose employment responsibilities relate only to
extracurricular activities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 21.002, Education Code, is amended by
adding Subsection (d) to read as follows:
(d) A school district may not employ under a contract a
person whose employment responsibilities to the district relate
only to one or more extracurricular activities.
SECTION 2. Section 21.002(d), Education Code, as added by
this Act, does not apply to a contract entered into by a school
district before the effective date of this Act.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
