 A BILL TO BE ENTITLED
 AN ACT
 relating to the provision of certain prescription medications to a
 foster child.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter A, Chapter 226, Family Code, is
 amended by adding Section 266.0042 to read as follows:
 Sec. 266.0042.  PRESCRIPTION MEDICATION REQUIREMENTS.  (a)
 Except in the case of an emergency, a foster child may not be
 prescribed more than four prescription medications to be taken
 concurrently unless the decision to prescribe the medications is
 reviewed and approved by an independent physician provided by the
 managed care organization providing health care services to the
 child under the STAR Health program.
 (b)  The department shall maintain a record of all
 medications prescribed for a child in the conservatorship of the
 department.  The record must include, for each medication, the name
 of the medication, the dosage amount, and the frequency with which
 the child is to receive the medication.
 SECTION 2.  This Act takes effect September 1, 2011.
