                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            April 19, 2011      TO: Honorable Wayne Smith, Chair, House Committee on Environmental Regulation      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB3544 by Farrar (Relating to the authority of the Texas Commission on Environmental Quality to grant or deny an air contaminant emissions permit.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would provide that if the Texas Commission on Environmental Quality (TCEQ) would find that emissions from a proposed facility would contravene the use of Best Available Control Technology (BACT), the protection of public health and physical property, or the intent of the Clean Air Act, the agency would be required to deny the application. The agency would be required to deny the application if an applicant would fail or refuse to alter its application in response to a deficiency report that the agency would issue upon making such findings.    This estimate assumes that the TCEQ could implement the provisions of the bill using existing agency resources.
