                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            April 17, 2011      TO: Honorable Jerry Madden, Chair, House Committee on Corrections      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB3762 by Marquez (Relating to creating a transparent and deliberative process by which execution procedures are determined.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend Article 43.14 of the Code of Criminal Procedure to require the Texas Board of Criminal Justice to determine at an open meeting the procedure for executing an offender by intravenous injection. The director of the Correctional Institutions Divison would be required to supervise the procedure and to notify the offender and his attorney of specific details regarding the lethal substances to be used.  No significant fiscal impact from the bill is anticipated by the Texas Department of Criminal Justice.
