       AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   Interested parties in northeast Houston support creating a municipal management district to encourage economic development, employment, housing, and public safety in the district and to preserve the unique character of the area. H.B. 3857 seeks to respond to local priorities through the creation of the Near Northside Management District.    H.B. 3857 amends current law relating to the creation of the Near Northside Management District.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.    SECTION BY SECTION ANALYSIS   SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3905, as follows:   CHAPTER 3905. NEAR NORTHSIDE MANAGEMENT DISTRICT   Sets forth standard language for the creation of the Near Northside Management District (district). Sets forth standards, procedures, requirements, and criteria for:   Creation, purpose, approval, territory of the district, eligibility for inclusion in special zones, and applicability of municipal management districts law of the district (Sections 3905.001-3905.050);   Size, composition, appointment, compensation, and terms of the board of directors of the district, including the naming of the initial directors (Sections 3905.051-3905.100);   Powers and duties of the district, including housing finance corporation powers, development of corporation powers, nonprofit corporation, law enforcement services, annexation, economic development, receipt of surplus property, and project for educational opportunity (Sections 3905.101-3905.150);   General financial provisions and assessments, financing services petition, disbursements and transfers of money, and utility property exempt from impact fees and assessments (Sections 3905.151-3905.200); and   Dissolution of the district (Section 3905.201).   Prohibits the district from exercising the power of eminent domain.   SECTION 2. Sets forth the initial boundaries of the district.   SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.   SECTION 4. Effective date: upon passage or September 1, 2011.
