The bill would amend the Transportation Code related to the procedures that a driver involved in an accident that results in damage to a structure adjacent to a highway must take. A person commits a Class C misdemeanor if the damage to all fixtures and landscaping is less than $200, or a Class B misdemeanor if the damage to all fixtures and landscaping is $200 or more. A Class B misdemeanor is punishable by a fine of not more than $2,000, confinement in jail for a term not to exceed 180 days, or both. A Class C misdemeanor is punishable by a fine of not more than $500. Local Government Impact Costs associated with enforcement, prosecution and confinement, and revenue gain from fines imposed and collected is not anticipated to have a significant fiscal implication.
