The bill would amend Chapter 12 of the Property Code relating to the release of a property owners association assessment lien by an affidavit as defined by the provisions of the bill. A person who is responsible for a false affidavit being executed and recorded would commit a Class A offense punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both. Other provisions of the bill would apply only to a property owners' association which is not a governmental entity. Local Government Impact Costs associated with enforcement, prosecution and confinement, and revenue gain from fines imposed and collected would vary depending on the number of offenses, but are not anticipated to have a significant fiscal implication.
