                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            April 1, 2011      TO: Honorable Sid Miller, Chair, House Committee on Homeland Security & Public Safety      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB520 by Driver (Relating to employment records for law enforcement officers, including procedures to correct employment termination reports; providing an administrative penalty.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend Chapter 1701.452 of the Occupations Code relating to employment termination reports of law enforcement officers issued by their employers (F-5 reports).  The bill would repeal sections (b) and (c) that previously allowed the Commission on Law Enforcement Officer Standards and Education to review a request for correction and order the report to be changed.  The bill would make it mandatory that this determination be referred to the State Office of Administrative Hearings for hearing.   The State Office of Administrative Hearings and the Texas Commission on Law Enforcement Standards have determined that the cost of implementing the bill would not be significant.   The bill would take effect immediately if it receives a two-thirds votes from both houses of the Legislature, otherwise it would take effect September 1, 2011.   Local Government Impact No significant fiscal implication to units of local government is anticipated.
