 A BILL TO BE ENTITLED
 AN ACT
 relating to requiring certain applicants for motor vehicle
 registration to provide proof that the applicant holds a valid
 driver's license.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter D, Chapter 502, Transportation Code,
 is amended by adding Section 502.1536 to read as follows:
 Sec. 502.1536.  EVIDENCE OF DRIVER'S LICENSE. (a) Except as
 provided by Subsection (d), a county assessor-collector may not
 register a motor vehicle owned by an individual person unless the
 owner provides proof that the owner holds a driver's license issued
 under Chapter 521 or a commercial driver's license issued under
 Chapter 522 that is valid at the time the application for
 registration is presented to the county assessor-collector.
 (b)  The department shall by rule prescribe the form of proof
 acceptable under this section.
 (c)  A county assessor-collector is not liable to any person
 for refusing to register a motor vehicle because of the person's
 failure to submit proof that the person holds a currently valid
 driver's license issued under Chapter 521 or a currently valid
 commercial driver's license issued under Chapter 522.
 (d)  This section does not apply to:
 (1)  a vehicle owned by a person 85 years of age or
 older; or
 (2)  a vehicle registered under Section 501.0234.
 SECTION 2.  The change in law made by this Act applies only
 to an application for registration submitted to a county
 assessor-collector on or after the effective date of this Act. An
 application submitted to a county assessor-collector before the
 effective date of this Act is covered by the law in effect on the
 date the application was submitted, and that law is continued in
 effect for that purpose.
 SECTION 3.  This Act takes effect September 1, 2011.
