A BILL TO BE ENTITLED
AN ACT
relating to certain restrictions on funds administered by the
Department of Agriculture.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 12, Agriculture Code, is amended by
adding Section 12.049 to read as follows:
Sec. 12.049. LIMITATIONS ON RESTRICTIONS ON FUNDS
ADMINISTERED BY DEPARTMENT. The distribution of money from a fund
administered by the department to encourage private economic
development may not be restricted on the basis of whether the county
in which or to which the funds are distributed has adopted or
enforces subdivision regulations, including the model rules
established under Section 16.343, Water Code.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
