                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            February 28, 2011      TO: Honorable Pete Gallego, Chair, House Committee on Criminal Jurisprudence      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB739 by Fletcher (Relating to the elimination of the statute of limitations for certain felony offenses.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Code of Criminal Procedure to eliminate the statute of limitations for an offense involving leaving the scene of a boating accident under Section 31.127(d) of the Parks and Wildlife Code, if the accident resulted in the death of a person.  The bill also eliminates the statute of limitations for tampering with or fabricating physical evidence under Section 37.09 of the Penal Code if the evidence relates to an investigation involving the death of a person.  To the extent the bill may result in increased filings in the court system, no significant fiscal impact statewide is anticipated.  The bill would take effect September 1, 2011. Local Government Impact No significant fiscal implication to units of local government is anticipated.
