 A BILL TO BE ENTITLED
 AN ACT
 relating to provision by the secretary of state of notice to a
 candidate of the form of the candidate's name that will appear on
 the general election ballot.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 161.008, Election Code, is amended by
 adding Subsection (d) to read as follows:
 (d)  Not later than the 30th day before the date the
 secretary of state makes a certification under this section, the
 secretary of state shall provide notice by certified mail, return
 receipt requested, to each candidate to be included in the
 certification. The notice must:
 (1)  contain the exact form for which the candidate's
 name will be certified for placement on the ballot; and
 (2)  provide information to the candidate on how errors
 in the form of the candidate's name may be corrected.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
