       AUTHOR'S / SPONSOR'S STATEMENT OF INTENT   Under current law, concrete crushing facilities are prohibited from operation within 440 yards of a building in use as a single family or multifamily residence, school, or place of worship. This bill would remove the distance restriction for a concrete crushing facility located within 25 miles of an international border, a county contiguous with the Gulf of Mexico, in a municipality with a population of not less than 6,100 but not more than 100,000, and within one mile of a United States highway.   As proposed, S.B. 1250 amends current law relating to the applicability of certain restrictions on the location and operation of concrete crushing facilities.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 382.065(b), Health and Safety Code, as follows:    (b) Provides that Subsection (a) (relating to concrete crushing facility distance) does not apply to a concrete crushing facility at certain locations, including at a location within 25 miles of a international border; in a county contiguous with the Gulf of Mexico; in a municipality with a population of not less than 6,100 but not more than 100,000; and within one mile of a United States highway. Makes a nonsubstantive change.   SECTION 2. Effective date: September 1, 2011.

SECTION BY SECTION ANALYSIS
