                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            May 9, 2011      TO: Honorable John Carona, Chair, Senate Committee on Business & Commerce      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:SB1309 by Hinojosa (Relating to rate adjustments by gas utilities.), Committee Report 1st House, Substituted    No significant fiscal implication to the State is anticipated.  The bill would authorize the Railroad Commission or a municipal regulatory authority to approve gas utility service rate adjustments based on changes in a gas utilitys revenues, expenses, or investments. The bill would also provide that the Railroad Commission shall presume reasonable any tariff or rate schedule to which a gas utility and a municipality agree. Passage of the bill is not expected to result in any signficant costs to the Railroad Commission.
