A BILL TO BE ENTITLED
AN ACT
relating to the powers of certain hospital districts regarding
district properties and facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The heading to Section 281.0511, Health and
Safety Code, is amended to read as follows:
Sec. 281.0511. CONTRACTING AUTHORITY AND POWERS RELATING TO
PROPERTY AND FACILITIES OF CERTAIN DISTRICTS.
SECTION 2. Section 281.0511, Health and Safety Code, is
amended by adding Subsection (c) to read as follows:
(c) Notwithstanding Section 281.050, the board may lease
any property, or hospital facility without the approval of the
commissioners court. The board must post public notice of any
proposed transaction under this subsection as required by Chapter
551, Government Code.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
